  • The respondents started using the same name for their company and Satyam Infoway brought suit for injunction.

  • Yes, domain names can be considered trademark as they are capable of distinguishing the said good or service to potential users of the internet.
  • They can be protected through passing off.
  • Court also said that although the trademarks act 1999 does not have any provisions for protection of domain names- does not mean that domain names cannot be protected legally through passing off
